In our city a private person not involved with any government action in any way is being allowed to use imminent domain to aquire properties for a private development. These properties are within a blighted and substandard area which according to local rules (explained to those of us living in this particular neighborhood) that "new construction" was not allowed but the improvement of existing structures could have "TIF" funds used. The developer has managed to use imminent domain with the permission of the local government body to obtain homes against the wishes of the owners and he is also being allowed the use of "TIF" fund for new construction. It was also explained to us that the use of imminent domain and it's intent was to aquire grounds that were or could be developed for public use only and not for private development. Is there any information that can be used to stop this missuse of a regulation for means other than it's true intended use? Is there any thing in this that would involve personal property rights or constitutional infringement?
