If your all wheel drive is full time 4 WD, then you have a problem. What you are experiencing is 4 wheel lock up, eventually you will run it until you feel a release that will feel like you ran over a 4 X 4 in the road.
If it were mine, (and all of my vehicles are 4 WD) Not only would I NOT drive it back, I would pay the towing, out of my own pocket, before I would drive it back.
If you talk to your dealer, or a reputable tire shop, they will tell you that when you replace tires on a 4 WD, that you should replace all 4 at once, an even when replacing all 4 you should line them up side by side, and make sure they all look to be the same. From time to time you will fine that 1 tire will be larger or smaller than the rest.
As far as the liability, check your OEM recomendations and present it to the warehouse that sold you the tires, tell them that they are responsible for installing the proper tires on your vehicle.
Be prepared to contact your lawyer, and that will be money well spent in case you cooked your transfer case.
